Terms of Service

Welcome to the VR Hand Hygiene Trainer. These Terms of Service ("Terms") govern your purchase and use of our virtual reality training software ("Software") from vrhandhygiene.com (the "Site"). The Software and Site are owned and operated by Ateo GmbH ("we," "us," or "our"). Please read these Terms carefully before purchasing or using our Software.

1. Acceptance of Terms

By purchasing, downloading, installing, or using the Software, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not use the Software. If you are using the Software on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on their behalf and bind them to these Terms.

2. Nature of the Software, Medical Disclaimer and Safety

The VR Hand Hygiene Trainer ("ViRTUE") is an interactive virtual reality training and educational simulation, intended for training, familiarization, and awareness only. It is not a medical product.

Not a medical device. The Software is not a medical device and is not certified, cleared, or approved under any medical-device regulation (including the EU Medical Device Regulation or the Swiss Medical Devices Ordinance). It is not intended to diagnose, treat, cure, prevent, monitor, or otherwise manage any disease, infection, or medical condition.

Not medically accurate. The germ visualizations, patient zones, transmission behaviour, feedback, scores, and analyses are a simplified instructional model created for teaching and engagement. They are not a scientifically or medically accurate representation of real pathogens, real contamination, real transmission, real infection risk, or real-world clinical outcomes. Any score or result reflects only the rules of the simulation and does not measure real-world competence or guarantee any reduction in infection or improvement in patient safety.

No medical advice; not a substitute. The Software does not provide medical, clinical, nursing, or other professional advice, and is not a substitute for professional training, supervision, official hygiene guidelines (for example the World Health Organization "Five Moments for Hand Hygiene"), your institution's protocols, applicable law, or your own professional judgment. You will not rely on the Software for any real patient care, clinical decision, or safety-critical purpose. Real-world hand hygiene must follow your institution's protocols and applicable guidelines and law.

Virtual reality safety. VR use carries physical risks. A small number of people may experience photosensitive seizures; VR may also cause nausea, dizziness, disorientation, or loss of balance. Clear your physical space of people and obstacles before use, supervise any permitted minors, follow your headset manufacturer's safety instructions, and stop if you feel unwell. You are responsible for your physical surroundings and safety while using the Software, and, to the maximum extent permitted by law, you assume the risk of injury or damage arising from your environment or your failure to follow these instructions.

3. Fees and Payment

The Software is sold through the distribution platform on which it is offered (for example Steam). When you purchase the Software, that platform processes your payment and associates the license with your account, enabling you to activate and use the Software. The price, any applicable taxes, and the scope of your purchase are as shown on the platform at the time of purchase.

4. Cancellation and Refund

Where you purchase the Software through a distribution platform such as Steam, refunds and cancellations are handled under that platform's refund policy, which applies to your purchase. Please submit any refund request through that platform.

Any mandatory statutory cancellation or withdrawal right you may have as a consumer is unaffected. Note that, for digital content supplied immediately, such statutory withdrawal rights may end once download or use has begun, to the extent permitted by applicable law. 5. Software License and Intellectual Property

License Grant: Subject to your compliance with these Terms and with the terms of the platform through which you obtain the Software (for example Steam), we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Software on devices you own or control, for your own training and educational purposes, for as long as your entitlement to the Software remains valid. Organizations may acquire multiple licenses to train their personnel, with one license per simultaneous user.

Intellectual Property: The Software and all intellectual property rights in it are the property of Universitätsspital Zürich (University Hospital Zurich, "USZ"), including the underlying invention and its further development. Ateo GmbH distributes and licenses the Software as USZ's exclusive, authorized licensee. The Software is protected by copyright, trademark, and other laws. This license grants you no ownership rights in the Software. "ViRTUE" and related logos are trademarks of their respective owners.

6. Acceptable Use

You agree not to:

  • Use the Software for any unlawful or fraudulent purpose.
  • Distribute, rent, lease, sell, or sublicense the Software or your license key.
  • Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Software.
  • Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the Software.
  • Use the Software to create any product or service that competes with the Software.
  • Transmit any viruses, malware, or other malicious code in connection with the Site or Software.

7. User Accounts

You may be required to register for an account with a distribution platform (such as Steam) to purchase the Software and manage your license. When you use such an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Be responsible for all activities that occur under your account, including the management of your license key.

8. Termination

This license applies for as long as your entitlement to the Software remains valid. It terminates automatically if you breach these Terms, and may terminate on expiry of any applicable license period. We may also terminate your license if you materially breach these Terms. Upon termination, you must stop using the Software and remove all copies in your possession or control.

9. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the Software is provided on an "AS IS" and "AS AVAILABLE" basis, and we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, and any warranty that the Software will be uninterrupted, error-free, secure, or achieve any particular result.

To the fullest extent permitted by law, Ateo GmbH, its directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, goodwill, or business, arising from or relating to the Software or these Terms. Ateo's total aggregate liability arising from or relating to the Software and these Terms will not exceed the total amount you paid for the Software.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable mandatory law, including liability for death or personal injury caused by negligence, liability for unlawful intent or gross negligence (in particular under Art. 100 of the Swiss Code of Obligations), liability under product-liability law (in particular the Swiss Product Liability Act), liability for fraud, and any mandatory rights of consumers. Where any limitation in this section is not permitted, it applies only to the extent permitted.

10. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the Software or your breach of these Terms.

11. Governing Law

These Terms and your use of the Software are governed by the laws of Switzerland, without regard to its conflict of law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods. Any dispute will be brought exclusively in the courts of Zurich, Switzerland, subject to any mandatory jurisdiction available to a consumer. If you are a consumer, you keep the protection of any mandatory provisions of the law of your country of habitual residence, and nothing in these Terms deprives you of those protections.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to use the Software after any revisions become effective, you agree to be bound by the revised terms.
